"I have just received the following message from Roger Hall regarding the Freedom of Information Act lawsuit he has brought against the CIA on behalf of the families of our POWMIAs":

"The CIA was given an extension from Dec. 18th and will respond to our filings after Christmas. There will be additional legal expense from here on. The court case funding is at a serious shortage. If the court approves our motion for discovery, we will not be able afford to afford the 8 depositions that are needed."

"There has been a response from a few individuals. The organizations like TFO of Kentucky has given $1,000, Rolling thunder National has also, VietNow gave $750 and the Vietnam and Gulf War Coalition gave $300. V V N W pledged to send a check. I am approximately $5,000 short of my veterans Day objective which was 10,000. There are to many spectators that expect that others will do it. I am fighting an organization with unlimited resources, but this case will be won."

There is plenty of information floating around about what Mr. Hall is attempting to do, but briefly he is suing the Central Intelligence Agency (CIA) to declassify all POW/MIA documents. Past Presidents have so ordered but the CIA is withholding much information that we feel would be very valuable in solving the POW/MIA cover-up and finding out why the cover-up continues.

On May 28, 1998 a Freedom of Information Act (FOIA) case was filed in U.S. District Court for the District of Columbia, 3rd St. and Constitution Ave., N.W. This litigation against the Central Intelligence Agency (CIA) is for the release of POW/MIA information that has been wrongfully withheld by this agency in violation of two Executive Orders and the FOIA. The case is being heard before Judge Friedman.

The CIA has acknowledged: Over 500 documents have been withheld for national security reasons; 40,000 pages released by the Senate Select Committee POW/MIA Affairs in 1993 are still classified by the CIA. The CIA has even withheld the identification of the above documents by name, number, or description. This is part of what we seek.

The CIA still withholds additional POW/MIA documents not yet admitted to. We have the evidence. We also have witnesses and will now ask the U.S. District Court to allow us to take discovery to identify the POW/MIA information and require the CIA to expand its document search.

From the day we inaugurated OJC, we have refused to solicit or accept funding of any kind. We have turned down offers of contributions that add up to more than is currently needed to pursue this important legal action. But now, the most important prospect we have for getting at the truth is in need of support. We urge each and everyone of you to reach down in your pockets and find a spare buck or two and send it to Roger. Both Gunny and I support Roger Hall's efforts in this matter. He has our utmost respect and confidence.

Every penny received goes directly to the payment of legal fees and court costs. Roger does not get a salary and he pays all of his own expenses. But lawyers don't work for free and the courts don't waive filing costs. All contributions will be accounted for.

We know this is the post-holiday season and that times may not be as prosperous for all of us as we would like them to be. But if you can find it within your means, consider sending a check to the:

Note from Gunny:

I smoke about 15 packs of cigarettes a week. At the new prices, that comes to about $50. If I buy them by the carton for just one week, I can save $10.50. That way I can send a check for $10 dollars. I don't have to cut down my smoking and the POW issue gets the savings.

If each member were to send half that amount, the litigation account would meet its needs quickly. But even a dollar helps. Please don't send cash. Send a check and put OJC on the back of the envelope so Roger knows who his friends are. It all comes down to this: The CIA, like every other government entity, is supposed to be working for us. Let's not let them forget it.

To our younger members of OJC: Please do not contribute without asking your parents. Always make sure they know what you are doing in regards to OJC. That's just the way we do things here.
